RESOLUTION #2003-01
NORMANNA CHECK SIGNATURES

WHEREAS, the town board of Normanna Township, St. Louis County, Minnesota has chosen Wells Fargo as its financial institution for managing its checking account;

WHEREAS, the town board of Normanna Township has required the signature of the town board chairman, the town clerk, and the town treasure on all checks issued in the name of Normanna Township;

WHEREAS, the town of Normanna in its 2003 March elections has elected to have the clerk and treasure’s positions combined into one position held by one elected official;

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of Normanna does hereby require that the signature of the town chairman and the town clerk/treasure be required on all checks issued in the name of Normanna Township.

RESOLUTION #2003-03

Board Recommendation to County on Butch Seeley’s Request for a Conditional Use Permit for a Borrow Pit on the East Pioneer Road

WHEREAS the Normanna Town Board of Supervisors have been informed of an application for a conditional use permit for a borrow pit on the East Pioneer Road. The name on the application is that of Butch Seeley of 5727 Arnold Road, Duluth MN., 55803;

WHEREAS the Normanna Town Board has notified the Normanna Land Use Committee of said application and the Land Use Committee held a public meeting on June 10th to discuss the application and to get residential input;

WHEREAS the Normmana Land Use Committee has recommended to the Normanna Town Board that the application of a conditional use permit for a borrow pit on the East Pioneer Road by Butch Seeley be accepted with some conditions placed on the permit;

THEREFORE, BE IT RESOLVED that the Normanna Town Board of Supervisors does hereby recommend the approval of the application of a conditional use permit for a borrow pit on the East Pioneer Road by Butch Seeley;

THEREFORE, BE IT FUTHER RESOLVED that the Normanna Town Board of Supervisors would recommend to the St. Louis County Planning and Zoning department that the following conditions, in addition to those that are already in place for borrow pits in the county of St. Louis, be placed on the Butch Seeley borrow pit permit:

Total dimension of digging area not to exceed 100ft wide by 150ft deep; Pit hours of 8AM-6PM, Monday thru Saturday; Limit hauling to 5000 cubic yds. in a year; No crushing allowed; Road access at top of hill; No sale of gravel to other contractors.

RESOLUTION #2003-04 Normanna Township Land Use Committee Members

WHEREAS, the Town of Normanna has updated its Long Range Land Use Plan and this plan was accepted by St. Louis County and went into effect on July 1, 2003;

WHEREAS, the Normanna Land Use Committee is made up of citizens who reside in the town of Normanna. The Town of Normanna recognizes that it is very important that the Land Use Committee continue to be staffed by the residents of the town;

WHEREAS, the Town of Normanna stresses the importance of maintaining a Land Use Committee that will serve the town on all land issues pertaining to the town;

THEREFORE, BE IT RESOLVED, the Town of Normanna board of supervisors does hereby create a permanent Land Use Committee of seven members who will be selected by the following guidelines;

A. All members need to be residents of the Town of Normanna;

B. All members need to be 18 years of age or older;

C. In 2004, each of the three township supervisors shall appoint two residents to the committee. They shall designate one resident as having a one-year term, and the other resident as having a two-year term. In the following years, each supervisor shall appoint one resident for a two-year term on the committee. These appointments shall be made at the May monthly board meeting;

D. The seventh member of the Land Use Committee shall be one of the township supervisors who is elected by majority vote to that position at the yearly reorganizational meeting following the annual election;

E. All efforts will be made to inform the residents of Normanna that there is a Land Use Committee and what is expected of the members of said committee;

F. Attached to this resolution is a set of guidelines that each supervisor may use when appointing a resident to the Land Use Committee.

RESOLUTION #2003-05

Duties of Normanna Land Use Committee Members

WHEREAS, the Town of Normanna has created a permanent Land Use Committee which is constructed of six town residents and one supervisor;

WHEREAS, the Town of Normanna has created this committee to deal with all land use issues which affect the town. The committee was also created to review the land use plan on an annual basis and to recommend any changes to the residents at the annual meeting;

WHEREAS, the Town of Normanna recognizes that this committee is strictly an advisory committee and that all final decisions on land use issues are to be made by the town board of supervisors;

WHEREAS, the Town of Normanna recognizes that the absolute final decision on land use matters pertaining to the town are made by the St. Louis County Planning and Zoning Commission;

WHEREAS, the Town of Normanna recognizes the need to have a list of duties that are required by each member of the land use committee;

THEREFORE, BE IT RESOLVED, that the town board of supervisors does hereby create a list of duties that are to be followed by the members of the Normanna Land Use Committee;

A. Each residential member will be appointed to a two-year term which will start and end at the May monthly board meeting;

B. Each residential member will have an equal vote on all land use issues;

C. Each member will be expected to meet on all land use issues that are brought before the town;

D. Each land use committee meeting shall be posted for 10 days prior to the meeting;

E. One member of the land use committee shall be elected by the members to take the minutes of each meeting. These minutes shall be handed over to the township clerk no later than 30 days after the meeting;

F. The township supervisor who is elected to the land use position shall be the chair of the land use committee. This person shall have the responsibility to call a land use committee meeting whenever the need arises;

G. The Chair of the land use committee shall give an update on all land use activity at each monthly board meeting;

H. The Chair of the land use committee shall be the liaison between the Town of Normanna and the St. Louis County Planning and Zoning Department;

I. All decisions made by the land use committee will be determined by a majority vote of the residential members. The chair of the committee will only have a vote in the case of a tie;

J. The land use committee may request to hold a public hearing on any land use matter. All public hearings must be legally posted and published as defined by Minnesota Statute;

K. A public referendum may be called on land use matters. This public referendum may be called as defined in Resolution #2003-06;

L. The resignation of any residential member of the land use committee must be submitted in writing to the town board of supervisors at least 2 weeks prior to a monthly board meeting;

M. If a member resigns, a replacement member will be appointed by the supervisor who appointed the original member or the supervisor who is currently serving in that capacity. This appointment will be made at the next available monthly meeting. The term of this new member will expire at the end of the term of the original member;

N. If a land use committee meeting is called, there must be at least 4 members present in order for the meeting to be legally held.

RESOLUTION #2003-06

Public Referendum on Land Use Issues

WHEREAS, the Town of Normanna has updated its Long Range Land Use Plan and this plan was accepted by St. Louis County and went into effect on July 1, 2003;

WHEREAS, the Town of Normanna has created a permanent Land Use Committee and its duties are defined in Resolution #2003-05;

WHEREAS, the Town of Normanna values the input of all residents and landowners in the town;

THEREFORE, BE IT RESOLVED, that the Town of Normanna does hereby set the guidelines for the calling of a public referendum on any land use issue;

A. All public referendums shall be called and conducted as defined by Minnesota Statute;

B. A public referendum shall be called if 5% of the township’s registered voters demonstrate a disagreement with the Board of Supervisor’s decision on any land land use issue. They shall demonstrate by submitting a qualified petition to the Town Clerk within 7 days of the Supervisor’s decision;

C. The Town Clerk shall immediately notify the town board chairman if such a petition is submitted;

D. The Town Chairman shall then call for a Public Referendum on the issue;

E. The public referendum shall be held at the Normanna Town hall unless the Chairman decides that a larger facility is warranted;

F. The majority ballot vote at the referendum will establish the Township’s recommendation to be forwarded to the St. Louis County Planning and Zoning Commission;

G. This recommendation shall be drafted in the form of a resolution;

H. The board of supervisors shall call a special board meeting immediately after the public referendum to address and to take the appropriate action as determined by the majority vote.
